Acceptance of Terms

By downloading, installing, or using Fairy Plus, you agree to these Terms of Use on behalf of yourself and any child using the app under your supervision. If you do not agree to these terms, please do not use the app.

These terms apply to all users of Fairy Plus, including children using the app with parental permission.

Who May Use Fairy Plus

Fairy Plus is designed for children and is intended to be set up and supervised by a parent or guardian. By allowing a child to use this app, you as the parent or guardian:

• Confirm you have read and agree to these Terms of Use and our Privacy Policy
• Accept responsibility for your child's use of the app
• Agree to supervise your child's outdoor activity when using the app

We encourage parents to walk with younger children during gameplay. Fairy Plus is an outdoor exploration app and requires moving around in the real world.

What the App Does

Fairy Plus is a location-based adventure game in which players walk around their neighbourhood to discover and befriend virtual fairies. The app uses your device's GPS to detect your position relative to fairy locations and in-app collectibles.

The app includes a parental PIN system that requires a parent or guardian to approve in-app rewards when a child completes a daily challenge.

Safe Use and Outdoor Activity

Please be aware of your surroundings at all times while using Fairy Plus.

• Always look up from your device when walking
• Do not use the app while cycling, driving, or operating any vehicle
• Stay on safe, familiar paths and public areas
• Do not enter private property, restricted areas, or any location that feels unsafe in order to find a fairy or collect a treat
• Parents and guardians of younger children should accompany them during outdoor play

Fairies in Fairy Plus are placed in publicly accessible areas, but we cannot guarantee that every spawn location will be safe or accessible in all circumstances. Use your judgement and prioritise safety above gameplay at all times.

Parental Responsibility

Because Fairy Plus is designed for children, parents and guardians bear primary responsibility for:

• Setting up the parental PIN and keeping it confidential from their child
• Reviewing and approving challenge completions before rewards are granted
• Ensuring their child understands and follows the safe use guidelines above
• Monitoring their child's location and activity while the app is in use

The parental PIN is stored locally on your device. We are not able to recover a lost PIN. If the PIN is forgotten, the app data will need to be reset by reinstalling the app.

Intellectual Property

All content within Fairy Plus — including fairy characters, artwork, names, stories, badges, and the Fairy Plus name and logo — is owned by or licensed to the developer and is protected by copyright and intellectual property law.

You may not:

• Copy, reproduce, or distribute any content from the app
• Modify, reverse-engineer, or create derivative works based on the app
• Use any Fairy Plus branding or characters for commercial purposes

Acceptable Use

Fairy Plus is intended for personal, non-commercial enjoyment. You agree not to:

• Attempt to manipulate, hack, or exploit any aspect of the app
• Use the app in any way that is unlawful or harmful to others
• Attempt to interfere with the app's functionality

Disclaimer of Warranties

Fairy Plus is provided as-is without warranties of any kind. We do not guarantee that:

• The app will be available at all times or free of errors
• Fairy or treat locations will always be accessible in the real world
• The app will function identically across all devices or operating system versions

Limitation of Liability

To the fullest extent permitted by law, the developer of Fairy Plus shall not be liable for any injury, loss, or damage arising from:

• Outdoor activity undertaken while using the app
• Trespassing or accessing unsafe locations while seeking in-app content
• Loss of app data due to device failure, reinstallation, or any other cause
• Any indirect, incidental, or consequential damages related to use of the app

Use of this app and all associated outdoor activity is at your own risk.

Changes to the App or These Terms

We reserve the right to update or discontinue any feature of Fairy Plus at any time. We may also update these Terms of Use periodically. The effective date at the top of this document will reflect the most recent revision. Continued use of the app after any changes constitutes acceptance of the updated terms.

Governing Law

These Terms of Use are governed by the laws of the jurisdiction in which the developer is located, without regard to conflict of law principles.
